As part of modernizing the Navy, the U.S. Government constructed on the subject property two buildings, then commonly known as The Steam Engineering Machine Shop (“The Machine Shop”) and The Foundry (“The Foundry Building”). The Machine Shop and The Foundry Building were integral parts of a foundry operation used by the Navy at the Key West Naval Base. Upon acquisition of the subject property from the United Stated Navy, The Machine Shop and The Foundry Building were included in that certain Memorandum of Agreement executed pursuant to Section 106 of the National Historic Preservation Act. In such agreement, the General Services Administration of the U.S. Government determined that certain existing structures within the Truman Annex should be preserved and made eligible for the National Register of Historic Places. Included among such historic buildings were Building 7, The Machine Shop, and Building 11, The Foundry Building. The Florida State Historic Preservation Office, a party to the Memorandum of Agreement, was charged with the responsibility of approving all renovations for such structures as in compliance with the Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings. The Declarant has obtained the necessary approvals for the renovations at The Foundry. No further structural modifications or renovations shall be made to The Machine Shop, The Foundry Building or any other historic building which may become part of The Foundry at the option of the Declarant without compliance with the terms and conditions of the Memorandum of Agreement.
